Date: Mon, 27 Feb 1989 12:20:00 -0500 1990-056 Hamilton County ORDINANCE NO. 9457 AN ORDINANCE AMENDING ORDINANCE NO. 9353 ENCAPTIONED, "AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE A TRACT OF LAND LOCATED IN THE 6100 BLOCK OF PRESERVATION DRIVE, BEING ON THE NORTHEAST LINE OF PRESERVATION DRIVE AT JERSEY PIKE FROM O-1 OFFICE ZONE AND R-1 RESIDENTIAL ZONE TO M-2 LIGHT INDUSTRIAL ZONE, SUBJECT TO CERTAIN CONDITIONS." TO CORRECT AN INADVERTENT ERROR IN THE LEGAL DESCRIPTION. _______________________ SECTION 1. WHEREAS, Ordinance No. 9353 contained an inadvertent error in the property description of the tract rezoned thereby; and WHEREAS, the staff of the Chattanooga-Hamilton County Regional Planning Commission has been notified of said error and agrees that said error should be corrected; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 9353, encaptioned as set forth above, be and is hereby amended to substitute the revised legal description as follows: A tract of land located in the 6100 block of Preservation Drive, being on the northeast line of Preservation Drive at Jersey Pike. Lot 10, Bonny Oaks Industrial and Office Park Subdivision, Phase One, as shown by plat of record in plat book 40, page 116, R.O.H.C., and an unplatted tract. Said lot and unplatted tract form one tract beginning on the southeast line of Jersey Pike some 187.13 feet northeast, then 27.86 feet northeast, then 147.55 feet northeast, then 50 feet northwest of the intersection of the southeast line of Jersey Pike with the northeast line of Preservation Drive, thence northeast some 1435 feet to the southwest corner of Lot 1, Bonny Oaks Cottages Subdivision, as shown by plat of record in plat book 40, page 147, R.O.H.C., thence with the southwest line of said Bonny Oaks Cottages subdivision southeast 438.63 feet, southeast 448.14 feet, and southeast 1083.38 feet to the northwest line of Lake Vista Subdivision Revised Unit 4, as shown by plat of record in plat book 20, page 92, R.O.H.C., thence southwest some 1488.48 feet with the northwest line of said Lake Vista subdivision to the southwest corner thereof, thence southeast 304 feet with the southwest line of said Lake Vista subdivision to the northwest line of Bonny Oaks Drive, thence southwest some 286 feet with Bonny Oaks Drive to the northeast line of Preservation Drive, thence northwest some 336.6 feet with Preservation Drive to the southeast corner of Lot 14, said Bonny Oaks Industrial and Office Park subdivision, thence northeast 370 feet with the southeast line of said lot 14 to the northeast corner thereof, thence northwest 410.81 feet with the northeast line of lot 14, and continuing with the northeast line of lot 12 and said line extended, to the centerline of a proposed 60 foot road right-of-way, thence southwest some 342 feet with the centerline of said right-of-way to the northwest line of Preservation Drive, thence southwest 238.43 feet with Preservation Drive to the southeast corner of lot 8, thence northwest 198.46 feet with the northeast line of lot 8 to the northeast corner thereof, thence southwest 260 feet with the northwest line of lot 8 to the northwest corner thereof, thence northeast 470 feet, thence northwest 410 feet, thence southwest 100 feet, thence southwest 210 feet to the southeast line of a proposed 60 foot right-of-way, thence southwest some 221 feet with said right-of-way to a point some 21 feet southwest of the northwest corner of lot 4, thence northwest 60 feet to the northeast corner of lot 2, thence continuing northwest 225 feet with the northeast line of lot 2 to the northwest corner thereof, said point being in the southeast line of lot 1, thence northeast 196.16 feet to the northeast corner of lot 1, thence northwest 215.43 feet with the northeast line of lot 1 to the southeast line of Jersey Pike, the point of beginning. SECTION 2. BE IT FURTHER ORDAINED, That Ordinance No. 9353 shall remain in full force and effect except as set forth above. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, the public welfare requiring it.
